A Conditons / course of Business
General terms
The following conditions are considered fully accepted and binding to the purchaser upon placement of an order, disregarding his own possibly differing conditions.
Customer information
Our up to date assortment, the product availability and pricing are listed on our homepage www.pesola.com. The printed catalog may not be fully up to date.
E-Shop
Our homepage is at the same time a worldwide e-shop. It also assists with the pricing calculation for potential orders. Order can be place with or without a customer account. Existing customers login with their e-mail address and password. For credit card payments, delivery to hotel addresses and P.O. boxes is not possible. In countries covered by exclusive distributors, customers are not able to order directly from PESOLA and will be referred the respective distributors. Otherwise no customer data will be handed on to third parties.
Offers
We renounce to offer standard catalog or homepage items as our e-shop calculates all costs automatically (printout shortly before aborting the ordering process in the e-shop). We are pleased to quote quantities of 50 scales or more as well as individual solutions.
Confirmation of orders
Orders via e-shop will be confirmed automatically by e-mail. Orders for standard catalog or homepage items, not placed via e-shop, will only be confirmed if PESOLA would not be able to deliver within 3 working days from receipt of order. Long term orders or orders for individual special models will be confirmed.
Terms of delivery
Delivery times are very short as we normally stock over 99% of our assortment for prompt supply. We deliver within 3 or 4 working days after receipt of order or prepayment. Unforeseen delay of delivery does not entitle the purchaser to claim any compensation or to cancel an order.
Dispatch / time of delivery
Dispatch in Switzerland is by DHL Domestic. For deliveries outside Switzerland the customer can choose between the option delivery by postal service or DHL. Additional administration for differing modes of dispatch is charged. Process speed of foreign customs and postal services is beyond our control. The link on www.pesola.com -> media -> download indicates the approximate delivery time, depending on the selection of the shipping mode in the e-shop. If a shipment is much delayed the customer can track and trace it on the Internet.
Insurance
All consignments are insured without surcharge.
Complaints
Complaints must be addressed in writing within 20 days of receipt of products. Pending complaints do not justify delay of payment.
Repairs
Returns are accepted only in accordance with PESOLA and at sender’s costs. A defect can possibly be repaired at low cost on site or simply by supply of a spare part.
Reversals
Orders for standard products can be cancelled at no charge as long as they are not invoiced and on the way to the customer.
Returns
Returns need to be agreed with PESOLA. Returned items have to be as good as new, corresponding to the present assortment and in perfect condition. At maximum we credit the proper product value invoiced. Possible expenses or reimport costs can be deducted from the credit note.
Warranty
PESOLA spring scales carry a 3-year warranty. Electronic scales carry the warranty listed on the detailed product sheet of our homepage. PESOLA AG reserves the right to decide whether the damage was caused by faulty materials, through normal wear, mishandling, or natural forces. Except in the case of faulty materials, the costs of repair, replacement and shipment are to be paid by the buyer.
Modifications
The manufacturer reserves the right to modify the assortment, the design, technical details of the scales and accessories at any time and without prior notice.
Proprietary right
The products remain the manufacturer's property until the bill has been fully paid.
Jurisdiction / Law
Legal domicile is Chur, Switzerland. Swiss law is solely applicable.
B Price list / Carry Costs
Currencies
Our price reference is Swiss francs (CHF). On customers request we invoice in EUR or in USD. A change of a once chosen invoicing currency requires our acceptance.
Price changes / Exchange rates
Possible price updates in Swiss Francs will be yearly around June 30th and December 31st. EUR and USD exchange rate fluctuations will be adjusted to the Swiss Franc four times a year around March 31st / June 30th / September 30th and December 31st without further notice.
Price lists / Terms and Conditions
Two up to date price lists (spring scales / electronic scales / Terms and conditions) in excel format are ready for download on our homepage. These lists and our homepage quote the same assortment and only their prices are up to date. The assortment in the printed catalog may not be fully up to date.
Standard sales prices
The prices quoted are the recommended net end-user prices excluding VAT, shipping, possible duty charges. The current market prices may vary depending on country, taxes, pattern of trade and margin of distributors.
Discounts (only for distributors and large customers)
Discount rates applicable may differ for the product group of spring scales and for the group of electronic balances and their accessories. On sales offers no further discounts are applicable. Registered dealers and large customers have their possible personal discounts marked on their customer data sheet. When ordering with our e-shop the discount rates are automatically displayed after login with your general e-mail address and password.
Small quantity surcharge (only for distributors and large customers)
Orders below CHF 100.00 net product value, before tax, will be subject to CHF 10.00 surcharge automatically calculated in the e-shop. The corresponding EUR and USD amounts are calculated at the PESOLA exchange rate (applicable also to the below mentioned packaging/administration fees).
Packaging / Administration
Packaging and administration-fee per delivery is CHF 8.00. This fee is not charged for e-shop orders. Special forms (e.g. for other than standard forwarding agents) and documents requested by customers are invoiced with CHF 25.00.
Calculation of shipping costs
Our e-shop evaluates the shipping weight of your inquiry or order. Depending on the selected mode of dispatch, the shipping costs will be calculated worldwide. The shipments shall be delivered “door to door”. Only abroad the postal service may charge the VAT and duty (no duty for PESOLA spring scales and accessories in the EU).
Conditions of payment
Payments from abroad shall carry the remark "free of charges for the recipient". Sorry, we are not able to accept any check.
- Payment by credit card (VISA / MasterCard / Postcard) is for security reasons only possible for e-shop orders.
- Prepayment (DVP, delivery versus payment), based on an automatic e-shop order confirmation or a pro forma invoice.
- In accordance with PESOLA, payment within 30 days net from date of invoice.
Payment is only complete, once the full invoice amount has been settled, without exchange rate loss or fees of any kind.
